Brand Ambassadors Competition Terms and Conditions

Information on how to enter the Promotion forms part of these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified.

Section 1: Promotion

  • A. Accor Plus members who upload videos in accordance with these Terms and Conditions of entry will go into the judging to win one(1) of nine (9) Major Prize’s of five free (5) nights’ accommodation at AccorHotels in the Asia Pacific (up to a retail value of AUD$1,500), and one (1) year membership/renewal (up to a retail value of AUD$395);  Runner Up prizes of: nine (9) year membership/renewal (up to a retail value of AUD$395). Further, by entering, they agree to the Winner Publicity as the Accor Plus Ambassador for 2019 as stipulated in 15. Winner Publicity.
  • B. Voters who vote and enter their personal details will go into the draw to win one (1) of nine (9) Accor Plus membership including one (1) free night accommodation at AccorHotels in Asia Pacific ( up to a retail value of AUD$395).

For A. at the conclusion of the Promotion, the top one (1) entry per region (Australia, New Zealand and Fiji, Indonesia, Malaysia and Singapore, India, Vietnam, Thailand, Philippines) with the most votes will be eligible to win a prize and only one (1) runner up per region will be eligible to win a prize (as described in Section 5).

For B. at the conclusion of the Promotion, a Voter will only be entered once and just  one (1) entry per region (Australia, New Zealand and Fiji, Indonesia, Malaysia and Singapore, India, Vietnam, Thailand, Philippines) will be drawn to constitute the winner.

These Terms and Conditions of Entry will be published on the Competition Website in English (English Version), and translated into Thai, Bahasa and Vietnamese (each a Translated Version). To the extent of any inconsistency between a Translated Version and the English Version, the terms of the English Version will prevail.

2. Promoter:

The promoter is Accor Plus (operated by Allegiance Marketing Pty Ltd ATF Allegiance Marketing Unit Trust) ABN 58 805 288 553. 110 Walker Street, North Sydney NSW 2060, Australia.

3. Promotion Period:

The Promotion will commence 12.01am on 07 November 2018 AEST and will close at 11.59pm on 21 December 2018 AEST.

Section 2: Eligibility

4. Eligibility:

To be eligible to enter the Promotion, the entrant must be: Promotion A:

  • A. Aged 18 years of age or older as at the commencement of the promotion
  • B. A current Accor Plus Primary or Supplementary member,

Promotion B: Aged 18 years of age or older as at the commencement of the promotion

Section 3: Non-Eligibility

  • A. Entrants are not eligible to enter the Promotion or win any Prize if they are: (i) an employee or immediate family member of an employee of the Promoter or AccorHotels worldwide or the Promoter’s related companies; or (ii) an employee of any marketing agency associated with the Promotion.
  • B. Accor Plus Partner and Partner Privilege members, together with Le Club AccorHotels. For promotion A, members who are not Accor Plus members, are also ineligible to participate.
  • C. The laws in some countries do not allow the Promoter to conduct this promotion, in which case the promotion and these Terms and Conditions of entry are void in those countries.

6. Further, any missing or incorrect information or contact details provided on the entry form, or any subsequent cancellation of an entry before the conclusion of the promotion, will render that entry invalid.

Entries must not include (i) any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person, or their parent/guardian if they are under 18. At the request of the Promoter all entrants must procure the relevant consents from anyone featured in any way in the entry, and provide these to the Promoter; (ii) any content that contravenes any law, infringes the rights of any person or is obscene, offensive, potentially defamatory, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and (iii) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Conditions of Entry.

Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.

By submitting an entry to the Promotion, each entrant agrees to assign all rights in the entry to the Promoter and consents to the Promoter using the entry in any manner the Promoter wishes (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all), by way of all media, without payment to the entrant (of royalties, compensation or otherwise). By submitting an entry, each entrant consents to any dealings with the entry that may otherwise infringe their moral rights in the entry. The Promoter may copy any content submitted as part of an entry, cause the content to be seen and/or heard in public, and communicate the content to the public. It may also allow third parties to do these things.

Section 3: Entry to the Promotion

7. To enter, entrants must, during the Promotion Period:

  • A. Go to the competition website at http://morehappiness.com, and register by completing the registration form,
  • B. Upload a video talking about their favourite Accor Plus experience as an Accor Plus member, together with a brief (no more than 300 characters) comment about themselves, on the Competition Website.
  • C. Only one (1) entry is permitted during the Promotional Period,

Entries will be displayed on the Website http://morehappiness.com. Entrants are strictly prohibited from using vote exchange mechanisms in order to influence the outcome of the Promotion. Any entrant found to be using vote exchange mechanisms will be disqualified. This is a game of skill and chance plays no part in determining the winner.

Section 4: Judging

8. Judging: During the Promotional Period, members of the public will be invited to vote for their favourite entries (one vote per entry and per day for the same Facebook ID). Voting may be done via the Competition Website morehappiness.com. In the event of a tie for a prize placing, representatives of the Promoter will judge the tied entries and choose the entry that is the most creative, original and best showcases an Accor Plus member experience (Judging Criteria).

9. Prize Winners: The Prizes described below in Section 5 will be awarded to the entries judged as described in Clause 8.

Section 5: Prizes

10. Prize Components: The prizes are as follows:

  • A. Major Prizes: the entry with the most number of votes will receive five (5) nights’ accommodation at the winner’s choice of AccorHotels within the Asia Pacific (up to a retail value of AUD$1,500) as well as a renewal of their membership (up to a retail value of AUD$395). AccorHotels within the Asia Pacific region are located in: Australia, India, Indonesia, Laos, Vietnam, Cambodia, China, Hong Kong, Taiwan, Macau, Fiji, Japan, Korea, Malaysia, New Zealand, Philippines, Singapore and Thailand. The (5) nights’ accommodation will be in a standard room and can be used within the following AccorHotels brands within the Asia Pacific, including: Fairmont, Sofitel, MGallery, Pullman, Swissotel, Quay West, The Sebel, Grand Mercure, Novotel, Mercure, ibis, ibis Styles and ibis Budget. The nights’ accommodation cannot be used during the following blackout periods which are: Country Public Holidays (including Christmas Day or the New Year period, New Year’s Eve or New Year’s Day) and Special Event days. All five (5) nights’ accommodation must be booked through the nominated representative of the Promoter by 31 December 2019 for stays between 15 January 2019 and 31 December 2019 and are subject to hotel availability. Any nights’ accommodation that are not booked by 31 December 2019 will be forfeited. The nights’ accommodation can be booked for a minimum of one (1) night to a maximum of five (5) nights during any given stay period at an Accor Hotel. All reservations using a complimentary night must be guaranteed with a credit card that is valid at the date of the start of the stay. Any cancellations of complimentary nights’ must be received by the nominated representative of the Promoter a minimum of three (3) days prior to the hotel stay or they will be forfeited. Details of how to book the five (5) nights’ accommodation will be provided to the winner in writing by the Promoter. All additional costs associated with redemption of the prize (such as flights, transfers, meals, spending money etc) are excluded, and will be the responsibility of the winner.
  • B. Runner Up Prizes: the next entry with the most votes per market will receive one (1) complementary renewal of their membership (at a retail value up to AUD$395)
  • C. Voters Prizes: One (1) Voter per region (Australia, New Zealand and Fiji, Indonesia, Malaysia and Singapore, India, Vietnam, Thailand, Philippines) will win an Accor Plus membership including one (1) free night accommodation at the winner’s choice of AccorHotels within the Asia Pacific (up to a retail value of AUD$395).

11. Prize Value: The total retail value of the Prizes to be won is valued at up to AUD$24165 inclusive of GST. Prize values are accurate as at the commencement of the promotion.

12. Prize Conditions: The Prizes are subject to the following conditions:

  • A. At the conclusion of the Promotion, the top one (1) entry per region (Australia, New Zealand and Fiji, Indonesia, Malaysia and Singapore, India, Vietnam, Thailand, Philippines) with the most votes will be eligible to win one (1) Major Prize and only one (1) Runner up per region will be eligible to win one (1) prize.
  • B. At the conclusion of the Promotion, a Voter will only be entered once and just one (1) entry per region (Australia, New Zealand and Fiji, Indonesia, Malaysia and Singapore, India, Vietnam, Thailand, Philippines) will be drawn to constitute the winner.
  • C. No exchange of Prize: Prizes will be supplied as described in these Terms and Conditions of Entry. The Prize can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and he/she does not wish to transfer the Prize, then the Prize will be forfeited;
  • D. Taxes: Winners will be responsible for any tax liability associated with a Prize.
  • E. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu.

Section 6: Prize Winners

13. Contact: The Promoter will contact each of the Prize Winners in writing and via phone within ten (10) business days of the conclusion of the Promotion Period to confirm their eligibility under these terms and conditions and to confirm whether the Prize Winners wish to claim their Prize. The names of the Prize Winners will also be published on the Website from 7 January 2019.

14. Claim of Prize: Prizes must be claimed by no later than 5.00pm on 5th February 2019. If the Prize Winners fail to do so by the deadline, the Prize Winners will be deemed to have forfeited their Prize.

15. Winner Publicity: In accepting a Major Prize, the Major Prize Winner agrees to be promoted as an Accor Plus Ambassador for 2019 and to participate in the following:

  • Appear in one (1) video testimonial and one (1) promotional video for the Promoter,
  • Contribute to a minimum of two (2) blog articles for the Promoter
  • Provide photos and comments on at least one stay that they have using their prize
  • Any publicity arrangements made by or on the behalf of the Promoter in relation to the Promotion

The Prize Winner further acknowledges that the Promoter reserves the right to publicise their name, state, country and photographs without any payment being made to them in respect of this Promotion.

Section 7: General Conditions

16. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.

17. Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winners, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

18. Force Majeure: Subject to applicable law, the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter.

19. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.

20. Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to entrants. This may include, but is not limited to, the names, email addresses, telephone numbers and other details provided by the entrant on the registration form. The entrant's personal information is collected so the Promoter is able to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and to publicise the Promotion.

21. Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering this Promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of the information collected pursuant to Clause 20 by the Promoter, which trades as Accor Plus. For details about who we are, how we may use your information and what your rights are under the new privacy laws, please see our Personal Data Policy, which is available from the Promoter at www.accorplus.com. Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant, or distribution of marketing materials for goods or services in the tourism, hospitality and services industries from the AccorHotels Group or from companies in the tourism and hospitality industry in which the Promoter holds shares.
